1. Acceptance of Terms

By downloading, installing, or using the Radial iOS application (the "App") or any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

2. Free Service

Radial is provided free of charge. We do not charge subscription fees, download fees, or in-app purchase fees to access or use the core Service. Your use may still incur standard charges from your mobile carrier or internet provider (for example, data usage), which are solely your responsibility.

3. Eligibility

You must be at least 18 years of age to use Radial. By using the Service, you represent and warrant that you are 18 or older and that your use of the Service does not violate any applicable law or regulation.

4. Identity Verification

Access to the Service requires successful completion of identity verification during onboarding. You must submit a valid government-issued ID and a live verification selfie. Verification is processed by our third-party provider (Stripe Identity). You agree to provide accurate and genuine identity documents. Submitting fraudulent or another person's identity documents is a material breach of these Terms and may result in immediate account termination and referral to law enforcement.

Raw verification images are deleted from our systems within 24 hours of processing. Your verification status (verified or not) is retained with your account.

5. Your Account

Your account is based on your phone number and SMS verification. If offered in the app, you may also link Apple, Google, or passkeys to the same account for login and recovery. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Only one active session is permitted per account at a time; signing in on a new device will invalidate your previous session. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

6. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Harass, threaten, stalk, or intimidate other users
  • Post false, misleading, or fraudulent profile information
  • Use another person's identity or impersonate any person
  • Attempt to gain unauthorized access to other users' accounts or our systems
  • Use automated tools (bots, scrapers, etc.) to interact with the Service
  • Attempt to manipulate or spoof your GPS location or BLE/UWB proximity signals
  • Distribute spam, malware, or other harmful content
  • Engage in any conduct that restricts or inhibits others' use of the Service

7. Location and Proximity Services

The Service requires access to your device's location and, on supported devices, uses Bluetooth Low Energy (BLE) and Ultra-Wideband (UWB) proximity detection (via Apple's Nearby Interaction framework) to confirm users are within 15 meters. By granting the required permissions, you consent to the collection and processing of your location and proximity data as described in our Privacy Policy. You may revoke permissions at any time in your iOS Settings, but doing so will prevent the Service from operating.

8. User-Generated Content

You retain ownership of content you submit (photos, bio text, and match chat messages). By submitting content, you grant Radial a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content solely for the purpose of operating the Service. You represent that you have all necessary rights to the content you submit and that it does not infringe any third-party rights.

Match chat messages are limited to one message per participant per match and are only available during the 24-hour match window. After expiry, messages may be deleted, soft-deleted, or anonymized as part of operating the Service. You acknowledge that the Service is designed around in-person connection and does not provide an unbounded messaging channel.

9. Blocking and Safety

You may block any user at any time by their phone number. Blocking permanently prevents that user from appearing in your discovery list, regardless of physical distance, and prevents them from sending you Match Requests. If a block is created between two users with an active match, that match may be closed immediately. We encourage you to use this feature if you feel uncomfortable. We also reserve the right to remove users who violate these Terms, without prior notice.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RADIAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED USD $100.

12. Indemnification

You agree to indemnify and hold harmless Radial and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may also delete your account at any time through the Settings screen. Upon account deletion, your profile is removed from all discovery lists, pending Match Requests are cancelled, and any active matches are marked as no longer available to the other participant. We may also delete or anonymize related messages and remove associated blocks, safe zones, and registered device tokens. Your right to use the Service ceases immediately upon termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Radial is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, through the app. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
