Terms & Conditions

1. Acceptance of Terms

By downloading, installing, or using the Radial iOS application (the "App") or any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age to use Radial. By using the Service, you represent and warrant that you are 18 or older and that your use of the Service does not violate any applicable law or regulation.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Harass, threaten, stalk, or intimidate other users
  • Post false, misleading, or fraudulent profile information
  • Use another person's identity or impersonate any person
  • Attempt to gain unauthorized access to other users' accounts or our systems
  • Use automated tools (bots, scrapers, etc.) to interact with the Service
  • Attempt to manipulate or spoof your GPS location
  • Distribute spam, malware, or other harmful content
  • Engage in any conduct that restricts or inhibits others' use of the Service

5. Location Services

The Service requires access to your device's location in order to function. By granting location permission, you consent to the collection and processing of your location data as described in our Privacy Policy. You may revoke location permission at any time in your iOS Settings, but doing so will prevent the Service from operating.

6. User-Generated Content

You retain ownership of content you submit (photos, bio text, notes). By submitting content, you grant Radial a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content solely for the purpose of operating the Service. You represent that you have all necessary rights to the content you submit and that it does not infringe any third-party rights.

7. Blocking and Safety

You may block any user at any time. Blocking prevents that user from seeing your profile or matching with you. We encourage you to use this feature if you feel uncomfortable. We also reserve the right to remove users who violate these Terms, without prior notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RADIAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR (B) USD $100.

10. Indemnification

You agree to indemnify and hold harmless Radial and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may also delete your account at any time through the Settings screen. Upon termination, your right to use the Service immediately ceases.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Radial is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, through the app. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
